What is a separation agreement?

  • Basically, it’s a set of rules that spell out how things will be done during your separation
  • It covers every aspect of dividing a household, including Custody, Child Support, Equitable Distribution (Assets and Debts), or Post-Separation Support/Alimony

Does it have to be done by an attorney?

Anyone can write down who gets what. The reason for an attorney becomes evident when you consider these facts:

  • Do you know your rights/obligations, specific to North Carolina law? The laws here are different than other states, and the wording needs to be specific in order to protect your rights.
  • Do you know how to ensure that it’s enforceable, or if it can continue to be enforceable even after the divorce?
  • Do you know what your priorities should be? What needs to be ironed out now, and what can be addressed later? The answer is not always as clear as you might think.
  • Lastly, and maybe more importantly, this process is emotionally charged and difficult, even in the best of circumstances. Negotiating in that environment is difficult, to say the least. It’s a good idea to have someone that knows the law, and has your best interests in mind, represent you.
